Privacy and personal data protection policy
Data management of the website https://www.b-bilichenko.com/ (hereinafter referred to as the “Site”) and the online course
“BIO-Mehanika” (hereinafter referred to as the “Online Course”) is carried out by the individual entrepreneur B. Bilichenko, who is registered and operates in accordance with the requirements of the legislation of Ukraine.
The Privacy and Personal Data Protection Policy (hereinafter referred to as the “Privacy Policy”) applies to all information that the Online Course, located at the address on the Internet: https://www.b-bilichenko.com/ receives about the User while using the Online Course website, programs and products of the Online Course.
We draw your attention to the fact that the Website and the Online Course have prepared this Privacy Policy taking into account the latest changes in the legislation regulating the protection of personal data, namely - taking into account the requirements of the General Data Protection Regulation (EU Regulation No. 2016/679 of 27.04.2016 or GDPR - General Data Protection Regulation).
1. DEFINITION OF TERMS
1.1. This clause defines the interpretation of the following terms, definitions and expressions used in this Privacy Policy.
1.1.1. “Site” - the web page of the Online Course, located at the domain name:
https://www.b bilichenko.com/ and managed by the Online Course Site Administration.
1.1.2. “Online Course Site Administration” (hereinafter referred to as the “Site Administration”) - authorized employees to manage the Site, acting on behalf of the Online Course, who organize and carry out the processing of personal data, and also determine the purposes of processing personal data, the composition of personal data subject to processing, actions or operations performed with personal data.
1.1.3. “User” - any individual who has access to the Site, who uses the Site via the Internet.
1.1.4. "Personal data" - any information that relates directly or indirectly to a specific natural person (personal data subject).
1.1.5. "Processing of personal data" - any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), blocking, deletion, destruction of personal data.
1.1.6. "Confidentiality of personal data" - a requirement that must be observed by the administration or another person who has access to personal data, not to allow their distribution without the consent of the personal data subject or the presence of another legal basis.
1.1.7. "Cookies" - a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request each time it tries to open a page of the corresponding site.
1.1.8. "IP address" - a unique network address of a node in a computer network, built using the IP protocol.
1.2. All definitions, definitions and terms not defined in this clause shall be interpreted in the meaning specified by the current legislation of Ukraine, and in the absence of such a definition - in their usual meaning.
2. GENERAL PROVISIONS
2.1. The User's use of this Site means the User's automatic and full consent to this Privacy Policy and the terms of processing the User's personal data.
2.2. If the User does not agree with the terms of the Privacy Policy, the latter is obliged to stop using the Site and immediately leave it.
2.3. The current Privacy Policy applies to the Online Course Site or to another site where course materials and programs are posted.
2.4. The Site does not control and is not responsible for third-party sites to which the User can go via links available on the Online Course Site.
2.5. The Site Administration does not verify the accuracy of personal data provided by the User to the Online Course Site.
2.6. The Site Administration is the controller of personal data of authorized users of the Online Course. The controller of personal data is the person who determines for what (for what purpose) and in what
way to collect personal data.
3. AGE RESTRICTIONS
3.1. By registering or booking an order on the Online Course Site, the User confirms that he has reached the appropriate age, which allows him to independently conclude contracts.
3.2. In the event that the Site Administration asks the User to consent to the processing of personal data, he can do so independently. By registering or booking an order on the Online Course Site, the User confirms that he has reached the appropriate age, which allows him to independently consent to the processing of personal data.
3.3. If the User has doubts about whether he can independently consent to the processing of personal data, he must contact the authorized body for personal data protection.
3.4. The Site Administration may contact the User with a request to provide additional documents or undergo additional procedures in order to verify that he has the right to independently consent to the processing of personal data. If the Site Administration has reasonable doubts about the User's age, it may also contact his parents or guardians in order to obtain consent or approval for the Processing of the User's personal data, if he has not reached the appropriate age. For the period of clarifying the circumstances or obtaining consent or approval from parents or guardians, the Site Administration may restrict the processing of the User's data by temporarily blocking the account.
4. SUBJECT OF THE PRIVACY POLICY
4.1. The current Privacy Policy establishes the obligations of the Site Administration to non-disclosure and ensure the confidentiality of personal data that the User must provide to the Site Administration upon request when registering or booking on the Site.
4.2. Personal data permitted for processing under this Privacy Policy are provided by the User by filling out certain forms on the Site or in an arbitrary format and may include the following information:
4.2.1. Full name of the User;
4.2.2. contact phone number of the User;
4.2.3. e-mail address of the User;
4.2.4. Instagram, Telegram account and others;
4.2.5. other confidential data about the User's identity or contacts of the User.
4.3. In addition to the data provided for in clause 4.2. of this Privacy Policy, the Site Administration reserves the right to automatically collect the following data during the User's browsing of the Site or its individual pages:
4.3.1. IP address of the User's electronic computing device (computer, phone, tablet, etc.);
4.3.2. information about Cookies data stored in the User's browser; information about the User's electronic computing devices (computers, phones, tablets, etc.);
4.3.4. information about the User's browser, including name, browser version, etc.;
4.3.5. time of access to the Site;
4.3.6. addresses of the Site pages viewed by the User;
4.3.7. addresses of previous pages from which access to the Site was obtained.
4.4. Disabling the Cookies collection function by the User may result in the inability to access parts of the Site.
4.5. The Site collects confidential data provided for in clauses 4.2.-4.3. of this Privacy Policy, including for the purpose of identifying and resolving technical problems of the Site, to control the load on the Site and to conduct statistical calculations of the effectiveness of advertising campaigns of the Online Course.
4.6. Any other personal or confidential information not specified above is subject to reliable storage and non-distribution, except for the cases provided for in clauses 7.2. and 7.3. of this Privacy Policy.
5. PURPOSES OF COLLECTING USER PERSONAL INFORMATION
5.1. The Site Administration may use the User's personal data for the purposes of:
5.1.1. Identification of the User registered on the Online Course Site, for placing an order and (or) joining the public offer agreement remotely.
5.1.2. Providing the User with access to personalized resources of the Site.
5.1.3. Establishing feedback with the User, including directing messages, requests related to the use of the Online Course Site, provision of services, processing requests and applications from the User.
5.1.4. Determining the User's location to ensure security and prevent fraud.
5.1.5. Confirming the authenticity and completeness of the Personal Data provided by the User.

5.1.6. Notifying the User of the Site about the status of the order.
5.1.7. Providing the User with effective customer and technical support in case of problems related to the use of the Site.
5.1.8. Providing the User with his consent, product updates, special offers, price information, news and other information on behalf of the Online Course.
5.1.9. Carrying out advertising activities with the User's consent.
5.1.10. Providing the User with access to the sites of the Online Course's partners in order to obtain products, updates and services.
5.2. The User's personal data may be used for other purposes not provided for by the Privacy Policy, which are within the scope of the Online Course.
6. DATA STORAGE
6.1. The Site Administration stores the User's Personal Data only as long as they are needed by him or the Site Administration for the purpose specified in this Privacy Policy. The latter also applies to any other third party performing certain actions on behalf of the Site Administration. If the Site Administration does not need certain data about the User and does not need to store them in accordance with the requirements of the law, it will delete them or store them in a way that makes it impossible to identify the User.
7. METHODS, PROCEDURE AND TIME LIMITS FOR PROCESSING PERSONAL INFORMATION
7.1. The User's personal data is processed without any time limit, by any lawful means, including in personal data information systems using automation tools or without the use of such tools.
7.2. By staying on the Site, the User automatically agrees that the Site Administration has the right to transfer personal data to third parties, solely for the purpose of fulfilling the User's order placed on the Online Course Site.
7.3. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular, courier services, postal organizations, telecommunications operators, and others solely for the purpose of fulfilling the User's order placed on the Online Course Site, including payment for the use of the Online Course products.
7.4. The User's personal data may be transferred to authorized state and judicial authorities only if there are legal grounds and a corresponding requirement.
7.5. In the event of loss or disclosure of personal data, the Site Administration shall inform the User of the loss or disclosure of personal data by any methods available to it.
7.6. The Site Administration shall take the necessary organizational and technical measures to protect personal information from unauthorized or accidental access, destruction, distortion, blocking, copying, distribution, as well as from other unlawful actions of third parties.
7.7. The Site Administration, together with the User, shall take all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
8. OBLIGATIONS OF THE SITE ADMINISTRATION TO PROTECT PERSONAL DATA
8.1. The Site Administration undertakes and guarantees the following:
8.1.1. To use any information received solely for the purposes specified in clause 5 of this Privacy Policy.
8.1.2. 8.1.3. To ensure the confidentiality and safety of the User's Personal Information. Not to disclose without the prior written consent of the User, and not to sell, exchange, publish or disclose in other possible ways the User's personal data transmitted, except for clause 7.2. and clause 7.3 of this Privacy Policy.
8.1.4. To take precautions to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect this type of information in existing business transactions.
8.1.5. Block personal data relating to the relevant User from the moment of the request or request of the User, or his legal representative, or the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of inaccurate personal data or illegal actions.
9. LIABILITY OF THE PARTIES
9.1. The Site Administration, if it has not fulfilled its obligations, is liable for losses incurred by the User in connection with the improper use of personal data in accordance with applicable law, except for the cases provided for in clauses 7.2., 7.3. and 9.2. of this Privacy Policy.
9.2. In the event of loss or disclosure of Personal Information of the User or Customer, the Site Administration is not liable if this information:
9.2.1. Became or was public at the time of loss or disclosure;
9.2.2. Was received from a third party before its receipt by the Site Administration;
9.2.3. Was disclosed with the consent of the User.
9.3. The Site Administration in all respects not provided for in clause 9.2. is liable
in accordance with applicable law.
10. DISPUTE RESOLUTION PROCEDURE10.1. The User and the Site Administration shall resolve all disputes and disagreements arising from the relations covered by this Privacy Policy through negotiations.
10.2. In the event of failure to reach an agreement, the dispute will be referred for consideration to the judicial authorities at the location of the defendant in accordance with the applicable procedural legislation.
11. ADDITIONAL TERMS11.1. The site administration has the right to make changes to the current Privacy Policy without the consent and notification of the User.
11.2. The new Privacy Policy comes into force from the moment of its posting on the Site, unless otherwise provided by the new version of the Privacy Policy.

11.4. The current Privacy Policy complies with the requirements of the legislation of Ukraine on the protection of personal data and contains detailed information on the data collected, the purposes, methods of their collection, processing, use and protection.
11.5. Note for users from the European Union: the current Privacy Policy has been prepared to fulfill the obligations stipulated by the General Data Protection Regulation (EU Regulation No. 2016/679 of 27.04.2016 or GDPR - General Data Protection Regulation).
